2006  Clackamas County Land Use Pilot Project  Region - Metro/Hood River

The Oregon Consensus Program has initiated a pilot project in Clackamas County to demonstrate the potential for using mediation and other collaborative approaches to prevent or resolve conflict in quasi-judicial land use cases. OCP is working closely with county staff, community planning organizations and other potential stakeholders

 

Project goals include developing criteria for selecting potentially controversial land use applications and identifying appropriate collaborative approaches for conflict resolution for those cases.  The OCP plans to identify the conflict resolution skills and resources needed for long-term implementation of pilot project recommendations and work with the County to identify options for obtaining these skills and resources. Protocols developed through this project will also be available to other local governments for implementation.

 

2006  Bull Mountain  Region - Metro/Hood River

The Oregon Consensus Program (OCP) conducted an independent assessment of issues and concerns related to governance, annexation, the provision of urban services, and other related issues in the unincorporated Bull Mountain area of Washington County, adjacent to the City of Tigard.   Assessment Report (pdf)

 

2006  North Clackamas Park   Region - Metro/Hood River

A group of citizens in Clackamas County requested assistance from OCP to help turn what had become a polarized, highly charged community conflict into a collaborative process around the land use approval and development of the North Clackamas Park.  With assistance from OCP, the county and citizens reached agreement that the citizens would support approval of a slightly modified land use permit application based on the County's agreement to establish an ongoing North Clackamas Park Stewardship Committee.  OCP provided assistance in establishing the Stewardship Committee as a collaborative process with all the interests represented and provided facilitation services until the Committee felt comfortable operating on its own.

 

2005 City UGB and BM 37 Claim (OCP 05-001) Region - Willamette Valley
Mediation of a LUBA appeal and a Ballot Measure 37 claim filed after the appeal assisted the parties to resolve some issues, but did not resolve the entire case.

2004 Ski Area Development Issues Region - Metro/Hood River
The first phase of mediation resolved a Court of Appeals case relating to a land exchange, and led to further discussions of a number of land use/development related issues involving future development of a ski area.

2004 Newberg UGB Expansion Involving Parks District Region - Willamette Valley
A dispute involving a UGB expansion to accommodate a proposed golf course to be developed by the Parks and Recreation District was appealed to LCDC. The dispute was resolved through mediation.

2002 Port of St Helens/Mining/Industrial Siting Region - Metro/Hood River
Mediated a dispute among interested parties which resolved a long standing land use dispute between the Port of St Helens, Scappoose and Glacier Northwest making 600 acres of land available for industrial and other uses.

2002 Roach v. City of Astoria Region - Northwest
A dispute between neighborhood interests and a developer who received a conditional use permit for construction of a mixed-use development constructed on pile structures was appealed to LUBA and resolved through mediation. The primary concerns were traffic generation in the neighborhood. The mediation successfully brought the petitioner, city and applicant together to resolve the matter and withdraw the appeal.

2002 Carver v. City of Salem Region - Willamette Valley
A dispute relating to requirements in the Salem Revised Code mandating park dedication was appealed to LUBA. The parties made significant progress on this case through mediation, then decided that some issues should be decided through the LUBA process. Additional settlement discussions followed LUBA review.

2002 Wild Rose v. Benton County Region - Willamette Valley
An aggregate case involving disputed conditions of approval, appealed to LUBA was assisted in settlement discussions.

2001 Thunder Mt/Baker Co Drag Strip Region - Eastern
This case involved an appeal of an application for a drag strip in a rural area of Baker County. The mediation involved neighbors, the proponent, the county and planning consultant. The parties reached agreement and withdrew the land use appeal.

2001 Beaverton Bus Barn Region - Metro/Hood River
This case involved a city action approving a storage facility for school buses owned by the local school district. Neighbors appealed the action to the Land Use Board of Appeals. The parties were not able to reach an agreement.

2001 Stafford Quarry Region - Metro/Hood River

As a result of 1999 legislation, a quarry operator and neighbors undertook mediation  to reach a settlement of portions of the dispute that remained in litigation.

2001 Cascade Locks Periodic Review Region - Metro/Hood River

This dispute over land use issues was resolved with the assistance of a mediator, resulting in dropping an appeal pending at the Court of Appeals.

2001 HB3557 Region - Statewide
This was a collaborative effort to review statewide land use requirements for commercial and industrial development. The effort involved a review of a technical report and recommendations to the Legislature. The stakeholders were diverse and represented state, local, community, business and industrial interests. The review of technical information and resulting recommendations was facilitated by a neutral.

2001 Copeland/Josephine County Region - Southwest
A local land use case involving the siting of an aggregate mining operation was successfully resolved.

2001 Linn County Enforcement Region - Willamette Valley
An enforcement order petition had been filed with the state Department of Land Conservation and Development over administration of planning provisions by Linn County. Through mediation the parties were able to reach a settlement resulting in withdrawal of the enforcement order petition.

2001 DLCD Budget Dialogue Region - Statewide
The Department of Land Conservation and Development was asked to significantly reduce its budget in response to state funding shortfalls. The agency convened a collaborative process to develop and consider alternative actions in response to the budget situation.

1999 Crook County Land Use Board of Appeals Cases Region - Central
Mediation of a series of eight separate Land Use Board of Appeals (LUBA) cases related to zoning and development in agricultural areas in Crook County involved multiple appeals and a diverse array of parties and public interests. The parties reached an agreement on how to resolve the dispute. Pursuant to the agreement, the cases were remanded to Crook County for action to implement provisions of the settlement agreement. During its consideration of the remanded decisions, the county allowed some new stakeholders to become parties at local hearings. As a result, additional issues had to be resolved.
